1. AGREEMENT TO TERMS

4.3 Pricing

All prices are listed in United States Dollars and are subject to change without notice. Prices do not include applicable sales tax, which will be calculated at checkout based on your shipping address.

5. ORDERS AND PAYMENT

5.1 Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including:

We process and ship orders within 5 business days. Delivery times vary based on shipping method selected and destination. Shipping costs are calculated at checkout.

6.2 Risk of Loss

All items purchased from our Site are made pursuant to a shipment contract. Risk of loss and title for items pass to you upon delivery to the carrier.

6.3 International Shipping

11.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

12. INDEMNIFICATION

13. GOVERNING LAW AND DISPUTES

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Florida, USA, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Site shall first be addressed through our customer service team. If the dispute cannot be resolved informally within forty-five (45) days, it shall be resolved through binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Orlando, FL, USA, and judgment on the award may be entered in any court having jurisdiction.

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court’s jurisdiction. Additionally, either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the use of the Site.

14.2 Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Site.

14.3 Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.

14.4 Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
